Another ruling of the Supreme Court extending the liability of the Insurance Company in the event of motor damage.

By the resolution of January 20, 2022 in the case No. III CZP 9/22, the Supreme Court decided that the insurer of the perpetrator of the accident is obliged to cover the costs of removing the engine fluids remaining after the collision from the road. The ruling was issued on the basis of a legal question presented by the District Court in Opole and is in line with the noticeable trend of extending the scope of liability of insurers of motor vehicle owners. The resolution is likely to end the dispute that has existed in the jurisprudence regarding covering these costs with the liability of the Insurance Institution for years, but the final conclusions can be drawn after the publication of the justification for the resolution.

After an accident, losses must be minimized. Discounts, however, raise doubts.

A common practice on the market is the Insurers’ payment of compensation calculated according to prices taking into account the rebates for spare parts negotiated by the Insurance Company. Despite numerous controversies regarding the admissibility of such an action, this issue has not been finally and legally resolved in the jurisprudence.

Adrianna Dobrzeniecka

Graduate of the Faculty of Law at the University of Warsaw. Adrianna joined the M&P in September 2020. She has gained her professional experience from the begininng of her studies as an apprentice and legal assistant. Adrianna is the finalist of the 1st National Competition on Economic Law “Meeting with the client”, organized by the European Law Students Association ELSA Poland. Her areas of interest include in particular: civil law, intellectual property law and commercial law.

Adam Grzegrzółka

He is a graduate of the Faculty of Law and Administration of the University of Warsaw. In 2021, he defended his master’s thesis entitled “The Civil Law Nature of the Option Relationship.” He is particularly interested in issues related to civil law with an emphasis on contract law and the civil approach to financial instruments, as well as commercial companies law. He has been working at the Firm since November 2019.

Katarzyna Zakrzewska

She provides comprehensive office services and ensures the proper internal functioning of the M&P. She conducts and coordinates administrative, economic and human resources matters, cooperating in this respect with all departments of the Firm and our external partners. Katarzyna is highly appreciated for her commitment and individual approach to the entrusted tasks. She is a graduate of the Faculty of Environmental Protection and Landscape Architecture at the University of Ecology and Management in Warsaw.

Anna Wesołowska

She has many years of experience in the field of office administration, both in administering a law firm and large business entities in the private and public sector.

Anna provides administrative support to the lawyers as well as supervises and directs the work of the other coordinators who support the various teams of lawyers in managing the documentation of cases handled at the Firm.

She is a graduate of the University of Management in the field of Administration.

Alicja Wierzbicka-Chmielewska

Currently, on behalf of the Firm, she supports the legal department of one of the largest Polish companies operating in the development industry, listed on the Warsaw Stock Exchange. She specializes in civil and economic law, in particular in issues related to obligations and the construction process. She represents entrepreneurs in civil and commercial disputes before common courts. She is a graduate of the Faculty of Law at the Kozminski University in Warsaw.

She is a member of the District Chamber of Legal Advisers in Warsaw.
